The short version

This summary doesn't replace the full text, but it covers what matters most:

1. Who we are and what you're agreeing to

1.1. Tripsettled (“the app” or “the service”) is provided by Osvaldo Rodriguez, an individual (not a company) located in Dallas, Texas, United States. In these terms, “we” and “us” refer to him. The service includes the tripsettled.com website, its subdomains (for example dev.tripsettled.com, the current test version) and any app we publish later.

1.2. By checking the acceptance box and using the app, you agree to these terms. If you don't agree, don't use the app.

1.3. How we handle your personal data is explained in the Privacy Policy, which you accept separately. The AI Use Policy, the Cookie Policy, the Subprocessors list and the Retention and Deletion Policy explain how parts of the service work, and they are part of these terms to the extent they apply to you.

1.4. Test phase. Tripsettled is currently in development. Only people invited to a trip or authorized by us can create an account. Features may change, fail or disappear during this phase.

2. Who can use Tripsettled

2.1. Minimum age. To create an account you must be 18 or older and legally able to accept these terms. You confirm this when you sign up.

2.2. If we learn that an account belongs to someone under 18, we will close it and delete their data.

2.3. Countries. For now, the service is offered to residents of the United States and Mexico. It is not directed at people in other countries.

2.4. Each person may have only one account. Use accurate information and don't impersonate anyone.

3. Your account

3.1. You can sign in with Google, with a magic link we email you, or with your email and a password.

3.2. Protect your access: don't share your password or the sign-in links we send you. If you think someone else got into your account, sign out of your sessions from My account and write to us at tripsettled.app@gmail.com.

3.3. To the extent the law allows, you are responsible for activity on your account until you tell us about unauthorized access.

3.4. Service emails. We send the emails the app needs to work: sign-in links, email verification, security notices and account deletion confirmations. They are not marketing. Other emails, such as trip reminders or notifications, only reach you if you turn them on.

4. What Tripsettled is and isn't

4.1. Tripsettled is a tool that helps a group plan its trip: the itinerary, who's going, where everyone sleeps, how people get around, and what the plan is missing.

4.2. We are not a travel agency. We are also not a tour operator, intermediary or seller of travel services. We don't make bookings, we don't charge for them, and we are not a party to any contract you make with airlines, hotels, lodging platforms, car rental companies, restaurants, tours or other providers (“third parties”).

4.3. Your bookings with third parties are governed by each third party's terms. Changes, cancellations, refunds, failures to deliver or safety issues with those bookings are between you and the third party, and we are not responsible for them.

4.4. Check the information. What you see in the app (times, addresses, prices, cancellation deadlines, travel times, weather and other data) may come from what trip members enter, from third parties or from automatic calculations. It may be incomplete, out of date or wrong. Confirm it with the original source before you decide, pay or leave.

4.5. “What's missing” is a helper, not a guarantee. If the app doesn't flag a gap, that doesn't mean your plan is complete. Travel documents, immigration requirements, insurance, health, driving and the care of minors are the responsibility of you and your group.

5. Expenses and payments: only a record

5.1. When the feature is available, you will be able to record expenses, payments between members and balances for information only.

5.2. We don't process payments. We don't move, receive or hold money, and we are not a financial institution, money transmitter or payment method. Payments between members (cash, Zelle, Venmo, bank transfers or others) happen outside the app.

5.3. Balances and the “who owes whom” view are calculations based on what members enter. They may contain errors. Currency conversions use reference exchange rates and are approximate.

5.4. We are not responsible for debts between users, or for collections, payments or disagreements between them, and we don't step into their disputes.

5.5. Nothing in the app is financial, tax or accounting advice.

6. Artificial intelligence features

6.1. We may offer artificial intelligence (AI) features, for example to import booking confirmations or suggest activities. None are active today.

6.2. AI can be wrong. It may misread a document, make up data, or suggest something that doesn't exist, is closed, costs something else or isn't safe. Always check what it proposes before you rely on it or pay for anything.

6.3. AI proposes, you decide. No AI feature changes your plan, your expenses or anyone's data without your confirmation.

6.4. Before we send your documents to an AI provider, we will ask for your explicit consent, and you can withdraw it whenever you want. The details are in the AI Use Policy.

7. Group trips: members, people without an account, and minors

7.1. Who sees what. What you add to a trip is visible to its members according to each item's visibility: the whole group, only you, or only the people involved. The app shows you who sees what. Some data is private by default, such as personal budget caps, spending level, the reasons you're unavailable, and health-related dietary restrictions.

7.2. People without an account. You can add adults who travel with you to a trip even if they don't have an account, with the minimum data needed to plan (for example their name or nickname, when they arrive and where they sleep). By doing so, you confirm that the person knows you are adding them. If they ask you to remove them, do so. That person can claim their profile when they create an account, or ask us to delete their data.

7.3. Minors. Minors don't have accounts. They can only be added as dependents of a responsible adult who is a trip member, with their name or nickname and whether they need a car seat. Their dietary restrictions are stored only with the consent of their responsible adult. Whoever adds a minor confirms that they are the minor's parent or guardian, or that they act with the parent's or guardian's authorization. Don't upload photos or any other data about minors.

7.4. Don't enter other people's sensitive data (for example, health data) beyond what a feature asks for, and not without their permission.

8. Your content

8.1. “Your content” is everything you write or upload: trip names, plans, notes, links, files and feedback, among other things.

8.2. Your content stays yours. You give us a non-exclusive, royalty-free, worldwide permission to store it, show it to the right members, back it up, protect it and process it only to run and improve the service. We don't use it for advertising. This permission ends when you delete that content or your account, with two exceptions:

8.3. You confirm that you have the right to upload your content and that it doesn't break the law or anyone else's rights.

8.4. We may remove content that breaks these terms or the law. We don't review all content and we are not responsible for other users' content.

8.5. If you send us ideas or feedback, we may use them to improve the service without any obligation to you.

9. Acceptable use

You may not use Tripsettled to:

10. Availability, changes to the service and price

10.1. The service is free today. If we charge for some features in the future, we will tell you the price and conditions in advance, and we won't charge you for anything you haven't accepted.

10.2. We may change, add or remove features. If we remove something important or shut down the service, we will give you reasonable notice (at least 30 days when possible) so you can export your data.

10.3. We don't guarantee that the service will always be available. There may be outages, maintenance or, in rare cases, loss of recent changes. Keep your own copy of anything essential, such as the original confirmations of your bookings.

11. Suspension and termination

11.1. You can delete your account at any time from My account. The Retention and Deletion Policy explains what happens to your data.

11.2. We may suspend or close your account if you break these terms, if the law requires it, to protect other people or the service, or if we shut down the service. When reasonable, we will tell you and explain why, and you can reply to tripsettled.app@gmail.com.

11.3. Sections 8.2 (what is kept as “Former member”) and 12 to 19 continue to apply after an account is closed.

12. Intellectual property

12.1. The app, its brand, its design and its software belong to us or to our licensors. We give you a personal, limited, non-exclusive, non-transferable and revocable permission to use them under these terms.

12.2. Some components are open source and are governed by their own licenses, listed on the app's licenses page.

13. Third-party services

The app connects with third-party services, such as Sign in with Google, links to open routes in Google Maps or Apple Maps, and WhatsApp share links. Those services have their own terms and privacy policies, which apply when you use them. We don't control them and are not responsible for them.

14. No warranties

The service is provided “as is” and “as available”. To the fullest extent the law allows, we make no express or implied warranties, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don't guarantee that the service will work without interruptions or errors, or that the information it shows is accurate. If the law where you live doesn't allow some of these exclusions, they apply only to the extent allowed.

15. Limitation of liability

15.1. To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data, opportunities, bookings or travel costs, arising from:

15.2. To the fullest extent the law allows, our total liability to you for any claim related to the service will not exceed the greater of USD 100 or what you paid us in the 12 months before the claim.

15.3. Nothing in this section limits our liability for willful misconduct or gross negligence, or any liability the law doesn't allow us to limit, including your non-waivable rights as a consumer.

16. Indemnification

To the extent the law allows, you will be responsible to us for third-party claims caused by your content or by your breaking these terms or the law.

17. Governing law and disputes

17.1. These terms are governed by the laws of the State of Texas, United States, without applying its conflict-of-laws rules.

17.2. Before bringing any claim, write to us at tripsettled.app@gmail.com and tell us about the problem. We will try to resolve it with you within 30 days.

17.3. If it isn't resolved, the dispute will be brought before the state or federal courts located in Dallas County, Texas, unless the law where you live gives you the right to bring a claim in the courts there. You may also use a small claims court if your case qualifies.

17.4. Nothing above takes away the non-waivable rights that your state's or country's consumer protection or data protection laws give you, or your right to go to the relevant authorities. In Mexico, the data protection authority is the Secretaría Anticorrupción y Buen Gobierno.

18. Changes to these terms

18.1. We may update these terms. Each version has a number and an effective date.

18.2. Important changes are those that significantly affect your rights or obligations, for example liability, dispute resolution, prices, minimum age or new uses of your data. We will tell you in the app or by email before they apply and ask you to accept them. Until you do, you will only be able to read the legal documents, export your data or delete your account.

18.3. Minor changes, such as wording fixes or clarifications that don't change your rights, apply as soon as they are published with their new version and date.

18.4. If you don't agree with a change, you can stop using the app and delete your account.
